Washington's Child Relocation Law

If you are a parent with full or primary custody of your child and plan to change residence, Washington State requires you to give notice to the child's other parent and any other individuals entitled to residential time with the child. At the Law Offices of Susan Amini, in Bellevue, we can help you develop solutions to problems arising from child relocation issues.

In this economy, many parents need to move in order to continue to support their children. However, you still have to give notice to the other parent before moving a child. How much notice and the form of the notice depends on how far you plan on moving.

Whether you are interested in an out of state move away or you simply want to move to another school district, the law regarding child relocation is complex and the requirements are strict. It is important you go through the process correctly.

Move-Aways and Non-Custodial Parents

We also represent either parent in disputes arising from move-aways. Having your child leave the area makes it much more difficult to continue a relationship. The non-custodial parent needs to enforce his or her rights to visitation. Petitioning the court for a modification of the parenting plan may be required. We can help you with this, and with any issue that arises because of child relocation.

Consequences for Unapproved Child Removal

If a child is removed from the area without the consent of the other parent, we can help either party resolve this dispute. We seek restraining orders prohibiting the relocation of the child or ordering the return of the child pending resolution at a Family Court hearing. If the relocating parent provides notice but fails to obtain consent or provide required information, such as the name and location of the child's new school, other action may be taken by the court.

Failure to comply with the requirements of Washington's child relocation law can result in serious sanctions, including a finding of contempt of court. If you are the non-custodial parent and do not make an objection to a proposed move in time, you lose your right to oppose it. The challenges are especially complex if you are involved in an international divorce and violate the requirements of the Hague Convention.
